1. Description of Our Services
Surplus Claim Advocates LLC provides surplus funds research, documentation preparation, and claim filing assistance services to help former Florida homeowners identify and recover surplus funds from foreclosure and tax deed auction sales. Our services are available to eligible property owners in Miami-Dade County, Broward County, and throughout the State of Florida.
We do not provide legal advice, and our services are not a substitute for the advice of a licensed Florida attorney. We are not a law firm.
2. Not a Law Firm or Licensed Real Estate Brokerage
Surplus Claim Advocates LLC is not a law firm. We are not a licensed real estate brokerage. We are not a certified surplus trustee as defined by Florida Statute 45.034. Nothing on this website or in our services constitutes legal advice, and no attorney-client relationship is created by your use of our website or services.

3. No Guarantee of Recovery
We make no guarantees that we will recover surplus funds on your behalf, or that any recovery will result in a specific amount. Surplus funds eligibility depends on the specific facts of your foreclosure or tax deed case, including the final judgment amount, auction sale price, outstanding liens, and applicable deadlines. Each case is different and results vary.
You should not rely on any testimonials, case results, or other examples on this website as a guarantee or prediction of any specific outcome in your case.
4. Contingency Fee Structure
Surplus Claim Advocates LLC works on a contingency fee basis. You pay nothing upfront. Our fee is a percentage of the surplus funds we successfully recover for you, as stated in your signed recovery agreement. If we do not recover any funds on your behalf, you owe us nothing.
The specific percentage and any applicable terms will be detailed in your signed service agreement before any work begins. Our contract is written in plain language and complies with applicable Florida law.
5. Your Right to Claim Without Representation
Under Florida Statute 45.032(3)(a), you are NOT required to hire a lawyer, paralegal, or any other representative in order to file a surplus funds claim. You also do NOT have to assign your rights to the surplus funds to anyone else. You have the right to file directly with the Clerk of Court on your own.
We provide our services as an option for those who prefer professional assistance with the process, but engaging our services is entirely voluntary.
6. User Obligations
By submitting a free eligibility form or engaging our services, you agree to:
- Provide accurate and complete information about yourself and the property in question
- Cooperate with reasonable requests for documentation needed to process your claim
- Notify us promptly of any changes to your contact information
- Act in good faith throughout the claims process
Providing false, misleading, or fraudulent information may result in the termination of our services and potential legal consequences.
7. Limitation of Liability
To the fullest extent permitted by law, Surplus Claim Advocates LLC and its members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of opportunity arising out of or related to your use of our website or services.
Our total liability in connection with any claim arising from our services shall not exceed the amount of fees actually paid by you to us under the applicable service agreement.
8. Agreement to Jurisdiction
Any dispute arising out of or related to these terms or your use of our services shall be resolved exclusively in the courts located in Miami-Dade County, Florida. You agree to submit to the personal jurisdiction of those courts for the purpose of resolving any such dispute.
9. Governing Law
These Terms of Service and your use of our services are governed by and construed in accordance with Florida law, including Florida Statutes 45.032 and 45.034, as applicable.
10. Termination
Either party may terminate our service agreement in accordance with the terms set forth in the signed agreement. We reserve the right to discontinue services if you provide false information, fail to cooperate with reasonable requests, or breach any provision of these Terms of Service or your service agreement with us.
11. Changes to These Terms
We may update these Terms of Service from time to time. Any changes will be posted on this page with a revised "Last Updated" date. The updated terms will take effect immediately upon posting. Your continued use of our website or services after any changes constitutes your acceptance of the revised terms.
